Terms

In making this booking you agree to the below:

 

  1. THE CONTRACT

The Contract is for a short-term holiday rental between Bath Spa Stays (“us” or “we”) and the person making the booking and all members of the holiday party (“you”, “your” or “guests”) under the following booking conditions. UK Law will govern this Contract.

 

The contract will be subject to these booking conditions and must be complied with. The party leader must be at least 18 years of age at the time of booking and must provide a list of all names and contact details of all guests on request.

 

 

  1. PAYMENT

A deposit of 40% is required to confirm your reservation. The balance must be received 30 days before the arrival date.

 

You will be sent notification when the balance is due. If the balance is not received in full and on time, we reserve the right to treat the booking as cancelled by you, in which case the deposit is forfeit.

 

If the reservation is made within 30 days of arrival the full amount is payable upon booking.

 

SECURITY DEPOSIT

 

A security deposit of £250 is required as a preauthorisation.

 

  1. CANCELLATION

CANCELLATION BY US

 

If we, for any reason we have to cancel your booking we will seek to offer you alternative dates or you will be refunded in full. This includes a Force Majeure event, including the following:

(a) acts of God, flood, drought, earthquake or other natural disaster;

(b) epidemic or pandemic;

(c) terrorist attack, civil war, civil commotion or riots, war, threat of or preparation for war, armed conflict, imposition of sanctions, embargo, or breaking off of diplomatic relations;

(d) nuclear, chemical or biological contamination or sonic boom; (e) any law or any action taken by a government or public authority, including without limitation imposing a restriction, prohibition, or failing to grant a necessary licence or consent;

(f) collapse of buildings, fire, explosion or accident;

(g) any labour or trade dispute, strikes, industrial action or lockouts;

(h) non-performance by suppliers or contractors; and

(i) interruption or failure of utility service, and the period of closure covers your booking

 

 

CANCELLATION DUE TO COVID-19

 

National Lockdown. A full refund will be issued if you are unable to travel and we are forced to close during the dates of your stay.

 

Regional/Local Lockdown:  A full refund will be issued if we are forced to close during the dates of your stay or in the event that your given address is put into Local/Regional Lockdown, rendering you unable to travel. Please note that this applies only to the addresses given on the booking by the lead booker and does not apply if an unidentified party member at a different address is unable to travel due to local lockdown.

 

 

CANCELLATION BY YOU:

 

Cancellations must be notified to Bath Spa Stays by email.

 

Bath Spa Stays will then use reasonable endeavours to obtain a replacement booking. If this is achieved, we will make a full refund less a 5% Booking Fee and less the difference in price between the original booking and the replacement booking.

 

 

Possible reasons for cancellation:

Your inability (or the inability of any, some or all of your intended party) or disinclination to travel to and stay at our property for any reason.  This includes – but is not limited to – illness (including Covid), a requirement or recommendation to self-isolate or quarantine, shielding, a call to jury duty, military service, incarceration, change in personal or work circumstances, family emergencies, travel delays, vehicle breakdown, and delays with public transport.  These remain at your risk and do not rise to a right to cancel or to receive a refund.

 

We strongly recommend you take out your own travel insurance for UK holidays which covers booking cancellations. This is available at very affordable rates, and gives you the peace of mind that you will get your money back if you need to cancel your holiday.

 

CANCELLATION CHARGES

If we are unable to rebook the property, the following cancellation charge will be made based on the number of days to check in:

4. THIRD PARTY SUPPLIERS (chef, crafts company etc.)

Please email at least 14 days before check-in if you intend to use a service of a third-party during your stay in order for us to see the third-party supplier’s public liability and receive approval.

5. Terms of Use

Guests can access the property from 2pm on the day of arrival and must leave by 11am on the day of departure. Failure to do so may result in you being charged a further day’s rental. You must not use the property except for the purpose of a holiday during the holiday period, and not for any other purpose or longer period. The agreement to stay in the property for the holiday period, does not create the relationship of Landlord and Tenant between the parties. You shall not be entitled to a new tenancy, or to any assured short hold or assured tenancy or any statutory protection under the Housing Act 1988 or other statutory security of tenure now or at the end of the Holiday Period.  On departure, you are requested to leave the accommodation in a clean and tidy condition. This includes washing up, placing rubbish in bin liners

6. NUMBER OF PERSONS USING THE PROPERTY

Under no circumstances may more than the maximum number of persons stated on the web site occupy the property. We reserve the right to refuse admittance if this condition is not observed. Any persons other than members of your party must not use the facilities at the property.

7. ACCURACY OF DETAILS

We will describe the property honestly and as accurately as possible but cannot be warranted, nor do the descriptions form any contract. Whilst every effort is made to keep images and descriptions up to date services and facilities may alter. We reserve the right to update, improve and alter any of the subjects without notice.

 

7. LIABILITY

Bath Spa Stays, its employees and representatives will not be liable to you or your party for loss, damage or injury to any of your party or your/their property. You must take all necessary steps to safeguard yourselves and your property.

8. CARE OF THE PROPERTY

The party leader is responsible for the property and is expected to take care of its furniture, pictures, fittings and effects, in or on the property. You are expected to leave the property in the same clean and tidy condition at the end of the rental period as at the beginning. Smoking and the use of candles is not allowed. Guests must not use the property for any dangerous, offensive, noisy, illegal or immoral activities or carry on there any act that may be a nuisance or annoyance to the owner or other neighbouring properties.

9. DAMAGES & BREAKAGES

The leader of the party must Inform the owner immediately in the event of damage to the premises or equipment. You are legally bound to reimburse us for the replacement, extra cleaning or repair costs on demand. However, we will use our discretion with smaller items such as glasses and plates.

10. LOSS OF KEYS

There will be a charge of £40 for each set of lost keys.

11. RESPECT OUR NEIGHBOURS

Ensure all guests are respectful of neighbours and do not make excessive noise. 

12. FIRE SAFETY

Ensure all guests adhere to the fire safety information provided in the welcome pack. All doors have self-closers so do not wedge open, do not obstruct the stair case and fire exits, do not light candles and take care when cooking.

13. RIGHT OF ENTRY

We shall be allowed the right of entry to the property at all reasonable times for purposes of inspection or to carry out any necessary repairs or maintenance.

14. COMPLAINTS

Every effort has been made to ensure that you have an enjoyable and memorable stay. However, if you have any problem or cause for complaint, it is essential that you contact us immediately to give us the chance to resolve it.

Pets are not allowed on the property

Please be sure to make the owners aware of any special requirements at the time of booking.

INFORMATION COLLECTED

We do not collect any personal information from visitors to our website other than information that is knowingly and voluntarily given. Anonymous information is collected, such as the number of visitors to the website in a given period or details of properties and dates selected for online bookings, but it is purely statistical and cannot be used to identify an individual user. Cookies are not used to collect any other information from visitors to the website.

USE OF INFORMATION

The information collected may be used to contact you with further details of our current activities or to send details of future initiatives or events. It may also be used for research purposes. You can inform us at any time if you no longer require such information to be sent.  We treat any data collected during the course of making bookings or dealing with enquiries in strict confidence. Your data will never be sold. 

THIRD PARTY DISCLOSURE

We will NEVER pass any personal information on to any third party without your consent.

DATA SECURITY

We take appropriate measures to safeguard the information we hold from unauthorised access or improper use. Our database is stored in a secure, password protected location. Only users authorised by us have access to this data.
